Please read carefully before using Como AI. By downloading, installing, or using the Como AI application, you agree to be bound by these Terms. If you do not agree, do not use the app.
1. Parties and Definitions
These Terms of Use and End User License Agreement ("Agreement") constitute a legally binding contract between:
- "COMO Lab" or "we" or "us": 16873944 CANADA INC., a corporation incorporated under the laws of Canada, operating as COMO Lab, the developer and operator of the Como AI application.
- "You" or "User": the individual or entity downloading, installing, or using the Como AI application.
- "App" or "Service": the Como AI mobile application, including all features, updates, and associated services.
2. License Grant
Subject to your compliance with these Terms, COMO Lab grants you a limited, non-exclusive, non-transferable, revocable license to:
- Download and install the App on devices you own or control
- Use the App for your personal, non-commercial purposes
- Access the features of the App in accordance with your subscription tier
This license does not include the right to sublicense, resell, or distribute the App or its content.
3. License Restrictions
You agree not to:
- Copy, modify, adapt, or create derivative works of the App
- Reverse engineer, decompile, disassemble, or attempt to extract source code from the App
- Remove or alter any proprietary notices, labels, or marks on the App
- Use the App for any unlawful purpose or in violation of any applicable laws or regulations
- Use automated systems, bots, or scripts to access or interact with the App
- Attempt to gain unauthorized access to any part of the App or its backend systems
- Interfere with or disrupt the integrity or performance of the App or its associated services
- Use the App to build a competing product or service
- Share your account credentials with third parties
4. Account Registration
To access certain features of the App, you must create an account. You agree to:
- Provide accurate, current, and complete information during registration
- Maintain the security of your account credentials
- Promptly notify us of any unauthorized use of your account
- Accept responsibility for all activities that occur under your account
You must be at least 13 years of age (or the applicable age of digital consent in your jurisdiction) to create an account. By creating an account, you represent that you meet this requirement.
We reserve the right to suspend or terminate accounts that violate these Terms, contain inaccurate information, or are used for fraudulent purposes.
5. Subscriptions and Payments
Subscription Plans
Como AI offers both free and paid subscription tiers. Paid subscriptions provide access to premium features as described in the App at the time of purchase. Feature availability may change over time.
Billing and Renewal
Paid subscriptions are billed in advance on a recurring basis (monthly or annually, depending on the plan selected). Subscriptions automatically renew at the end of each billing period unless cancelled at least 24 hours before the renewal date.
Payment Processing
All payments are processed by Apple (App Store) or Google (Google Play), in accordance with their respective terms of service. COMO Lab does not directly process or store your payment information.
Refunds
Refund requests are governed by the App Store or Google Play policies of the platform through which you made your purchase. COMO Lab does not issue refunds directly. To request a refund, please contact Apple or Google through their standard refund processes.
Price Changes
We may change subscription prices. We will provide at least 30 days' advance notice of any price increase. Continued use of a paid subscription after a price change constitutes your acceptance of the new price.
Free Trial
If a free trial period is offered, it will be clearly stated at the time of sign-up. At the end of the trial period, your subscription will automatically convert to a paid plan unless cancelled before the trial ends.
6. User Content
You may input, upload, or generate content through the App, including pet profile information, health notes, and behavioral observations ("User Content"). You retain ownership of your User Content.
By providing User Content, you grant COMO Lab a limited, non-exclusive, worldwide license to store, process, and use your User Content solely to operate and improve the App and provide the Service to you. We do not use your pet's personal data to train AI models shared with other users without your explicit opt-in consent.
You represent and warrant that your User Content does not infringe the rights of any third party and does not violate any applicable laws.
7. Medical and Veterinary Disclaimer
Como AI is not a substitute for professional veterinary care. The App provides informational and educational content based on AI analysis of behavioral data. It is not intended to diagnose, treat, cure, or prevent any illness or medical condition in animals.
The behavioral insights, health observations, and recommendations provided by Como AI are generated by machine learning models and are inherently probabilistic. They may be incomplete, inaccurate, or inapplicable to your specific animal's situation.
Always consult a licensed veterinarian for any health concerns about your pet. Do not delay seeking professional veterinary advice because of information or analysis provided by Como AI.
COMO Lab, its directors, employees, and contractors are not liable for any harm, illness, injury, or death of any animal arising from reliance on the App's analysis or recommendations.
8. Intellectual Property
The App and all of its contents — including but not limited to software, algorithms, AI models, design, text, graphics, logos, and user interface elements — are the exclusive property of 16873944 CANADA INC. (COMO Lab) and are protected by Canadian, US, and international intellectual property laws.
Nothing in these Terms grants you any right, title, or interest in the App or its intellectual property, except the limited license expressly granted in Section 2.
"Como AI", "COMO Lab", and associated logos and marks are trademarks of 16873944 CANADA INC. You may not use these marks without our prior written permission.
9. Disclaimer of Warranties
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
COMO LAB DOES NOT WARRANT THAT:
- The App will be uninterrupted, error-free, or secure
- Any defects or errors will be corrected
- The App or its servers are free of viruses or harmful components
- The results obtained from using the App will be accurate, reliable, or complete
Some jurisdictions do not permit the exclusion of implied warranties; the above exclusions may not apply to you in full.
10. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, COMO LAB (16873944 CANADA INC.), ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION:
- Loss of profits, data, or business
- Harm to or death of any animal
- Personal injury arising from reliance on App content
- Unauthorized access to your data
IN ANY CASE, COMO LAB'S TOTAL CUMULATIVE LIABILITY TO YOU FOR ALL CLAIMS ARISING FROM OR RELATED TO THE APP SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO COMO LAB IN THE TWELVE MONTHS PRECEDING THE CLAIM, OR (B) CAD $100.
11. Indemnification
You agree to defend, indemnify, and hold harmless COMO Lab (16873944 CANADA INC.) and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, costs, and expenses (including reasonable legal fees) arising out of or in connection with:
- Your use of the App
- Your violation of these Terms
- Your violation of any applicable law or third-party right
- Your User Content
12. Termination
You may terminate your account at any time by deleting the App and contacting us to request account deletion.
COMO Lab may suspend or terminate your access to the App at any time, with or without notice, for any reason, including if we reasonably believe you have violated these Terms.
Upon termination, the license granted to you immediately ceases. Provisions of these Terms that by their nature should survive termination shall survive (including Sections 7, 8, 9, 10, 11, and 13).
13. Governing Law and Dispute Resolution
These Terms are governed by and construed in accordance with the laws of the Province of Quebec, Canada, without regard to its conflict of law provisions.
Any dispute arising from or related to these Terms or the App shall first be subject to good-faith negotiation. If not resolved within 30 days, disputes shall be submitted to binding arbitration in Montreal, Quebec, Canada, under the rules of the Canadian Arbitration Association, unless applicable law requires otherwise.
You waive any right to a jury trial and agree not to participate in any class action lawsuit against COMO Lab.
14. Apple App Store Additional Terms
If you downloaded Como AI from the Apple App Store, the following additional terms apply. You acknowledge that:
- This Agreement is between you and COMO Lab (16873944 CANADA INC.) only — not Apple Inc.
- Apple has no obligation to provide any maintenance or support for the App
- Apple is not responsible for addressing any claims relating to the App, including product liability, consumer protection, or intellectual property claims
- Apple is a third-party beneficiary of this Agreement and may enforce it against you as a third-party beneficiary
- In the event of any failure of the App to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any) for the App. Apple has no other warranty obligation with respect to the App.
The license granted to you is limited to a non-transferable license to use the App on any Apple-branded products you own or control, as permitted by the App Store Usage Rules set forth in Apple's Terms of Service.
15. Changes to These Terms
COMO Lab reserves the right to update these Terms at any time. When we make material changes, we will notify you through the App or by email at least 14 days before the changes take effect. Your continued use of the App after the effective date constitutes your acceptance of the revised Terms.
If you do not agree to the revised Terms, you must stop using the App and delete your account.
